Document solid reasons for firing complainer ? Business ...

Employees who complain can be annoying, especially if you believe their gripes don?t have merit. But firing such an employee can be dangerous because complaining about discrimination or other legal issues is protected activity that can?t be punished.

That?s true even if it turns out the employee?s complaint wasn?t valid, as long as it was made in good faith.

Before you terminate an employee who has engaged in protected activity, make sure your reasons are solid and can survive scrutiny in court.

Recent case: Mary worked as a technical writer and got frequent opportunities to take on extra assignments and management tasks outside her job description. Her supervisor believed she deserved more pay and a promotion and even went as far as to recommend the creation of a new position for her. However, that never materialized.

Mary watched her employer hire men for other positions she wanted and began complaining that she was losing out on opportunities because she didn?t ?have a penis.? Shortly after she made that comment (and after receiving a positive performance review), she was told she was being let go to save money.

Mary sued, alleging sex discrimination in promotion, as well as retaliation for complaining.

She lost her discrimination claims, but the court said her retaliation claim could proceed. It reasoned that a jury might perceive her sudden termination despite good reviews as punishment for complaining. That was especially true since she was the only employee terminated, and a man soon took over her old job. (Frintner v. Trueposition, No. 11-3454, ED PA, 2012)

Final note: If you plan to use financial reasons to justify a termination, back it up. Show solid business reasons, such as falling earnings, higher overhead or a management directive to cut labor costs.

(AP) ? Mark Lyons hit a contested layup with 7 seconds left and No. 8 Arizona rallied from a six-point deficit in the final minute to pull out an improbable 65-64 win over No. 5 Florida on Saturday night.

Arizona (8-0) struggled with Florida's mix of zone and man defenses, falling behind by 11 in the second half before rallying late. The Wildcats used their press to force consecutive turnovers on inbounds plays, pulling within 64-63 after Grant Jerrett hit one of two free throws.

Arizona fouled Kenny Boynton, who missed the front end of a 1-and-1, then raced to the other end for Lyons' driving shot.

Florida (7-1) botched its final possession, fumbling the ball away before taking a wild 3-pointer.

Solomon Hill had 18 points, Nick Johnson added 15 and Lyons 14 to give Arizona its best start since opening the 1998-99 season with eight straight wins.

Mike Rosario led Florida with 16 points and Erik Murphy added 15.

The Gators and Wildcats cruised through their early schedules to set up the McKale Center's first matchup between top 10 teams since 2004.

Florida came to the desert with a stifling defense ? second nationally at 48.3 points per game ? and the nation's third-widest margin of victory, winning by an average of 25.3 points. The Gators have a talented frontline, experienced guards and good balance.

Florida turned its first true road game of the season into a walkover, holding Florida State to its lowest point total ever at the Tucker Center in a 72-47 win on Dec. 5.

Arizona also has a talented frontcourt and steady guards, though is a bit more offensively oriented, averaging nearly 80 points while winning by 20 a game. The Wildcats rely on three heralded freshmen ? Kaleb Tarczewski, Brandon Ashley and Jerrett ? but also have a core of veteran players coach Sean Miller can turn to when things get tight.

The older guys came through down the stretch in a win over Southern Miss on Dec. 4 and again last Saturday, when Lyons, a graduate transfer from Xavier, scored 20 points in a 66-54 road win over Clemson.

Putting the Gators and Wildcats together on the same court set up one of college basketball's best nonconference games of the season, one that had the McKale Center rocking despite the late start and school out for the semester.

The teams put on an offensive show in the early going, trading 3-pointers and baskets inside.

Arizona couldn't keep it up.

Struggling against Florida's ever-changing defense, the Wildcats couldn't seem to make anything, open or contested, and had some careless turnovers while going 7? minutes between field goals. Arizona hit a few shots to get the crowd back into it, then went cold again, falling behind 30-19.

The Gators slowed down on offense, too, just a little later.

Florida went through a shooting funk midway through the first half, hit a few shots and labored down the stretch, going scoreless over the final 3:06 to shoot 12 of 33.

Arizona closed within 32-29 at halftime after Johnson hit consecutive 3-pointers and Hill scored on a breakaway dunk off a steal just before the buzzer. The Wildcats shot 9 of 22 in the half.

Arizona kept missing to start the second half. Florida didn't.

The Gators made seven of their first eight shots, going up 49-39 on Scottie Wilbekin's 3-pointer from the wing.

But the Wildcats weren't done, finally getting a few shots to fall and pulling to 61-58 on long 3-pointers by Johnson and Lyons from the same spot with about 5 minutes left to set up the wild finish.

'I want to look good', is what I though my self a couple days ago, meaning I want to look muscular. I am sixteen years old, I'm quite tall, got short thick dark hair, and wear glasses. Realtives and friends of the family have told me I am handsome, so you could say that I look quite good already. However, although I'm tall, I'm really scrawny, and don't exactly have an attractive body due to spots on my back and chest-and my face-, and have quite pale skin. I have a twin brother who is less tall than me, but used to play rugby, goes to the jym a lot, drinks lots of protein shakes and pretty much never touches food with to much fat in. He looks very well formed, and I have heared quite a few girls talk about their interest in him.

So I decided that I'm going to try and attend my local jym three days a week for an hour. I used to attend this jym and used a program whuich included the tredmill, and the rowing machine. I stopped because I decided if I just want to get fit, I might as well just run outdoors, which is something I actually enjoy doing as opposed to benching at the jym. But here is my point, the reason why I stopped going is becuase I figured I wasn't enjoying it very much, but I've started again now because I want the girls at my college to notice an improvement in my physicality, and maybe show more of an interest in me. That is actually my goal for the begining of next term!

Now when I think about it, that's quite a shallow reason to go to the jym, but more importantly if it's not going to be something I enjoy, I'll be wanting to improve too fast, and instead of enjoying the journey I'll just be obsessing over the destnation, and might not be very happy. However, as shallow as it sounds when I use my brain, I don't think it's to bad of a reason. When you see people like Brad Pitt, and Bruce Willis, don't you think 'I could be like that with the right amount of focus and hard work, and get simialr attention-I say similar, because I know 60% of the reason why they get feamle attention, is because they are celeberities-So why shouldn't you?

I suppose another reason why I want to look muscular, which could bee seen as a good enough and non shallow reason, is that it'll give me a massive confidence boost, and make me feel much more happier and comfortable in my own skin.

What do you guys think about this?
Cheers! Very Happy

I am sixteen too with AS, and I have been lifting since i was 12, but didn't get anywhere till like tenth grade, when I finally got a growth spurt lol.
I've gone pretty regularly since March, and I'm pretty good about food too.

You really need to do some resistance and weight training if you want to be fit.

Being fit generally makes you look pretty good.

I lift primarily to get stronger, secondarily to brag about my lifts, tertiarily for the ladies when I take off my shirt at the beach...not anytime soon lol. Laughing

For me, my fitness "journey" was a bit different than most. I was in good shape as a kid, then after a divorce, my mother did the cooking and only bought processed food and I ballooned. I also have NVLD, and a bit of dyspraxia to go with it, meaning I'm not naturally good at like, anything athletic. But figure skating made me lose a lot of weight, and gave me something athletic to like, try at. I went from 215 to 180 from just skating.

Then I started lifting to get better at figure skating, and now it's sort of it's own thing, but I'm trying to keep it in check now, as it has in the past interfered with figure skating due to me being overzealous about it. For me, looking good wasn't quite as much in the equation with lifting at all. I wanted to be strong. Even as a kid, my dad bought me a little standard weight bar, and I'd like, clean and press it with like 50lbs on it or something. I liked the idea of being STRONG a lot. Strength is sweet. Looks were apart of the equation, as in I didn't wanna look like this:

But I figured my problems with the ladies weren't how I looked really. I mean I certainly notice more attention from them at 180 and 190s (I'm 190 or so now from weightlifting and eating a lot, would like to be 180 or 170s at lower bodyfat.)

But for me, it was really just the strength aspect that got me at first. I'd see things like this, and get inspired by it.

Even as a kid, with anime and whatever, I thought being strong was just totally cool. The Baki the Grappler opening about sums it up.

"If one is born as a male, at least once in his life, he'll dream of becoming the strongest man alive."

But now, I do wanna look like, better. Part of it's like, through weightlifting, I didn't do it to gain mass or whatever at all, but I've apparently put on at least 10lbs of muscle since I started. Like I didn't know ANYTHING about anatomy or whatever before lifting. So like "yeah man, you could get huge lats" or whatever didn't like, make sense to me. And I felt like a huge idiot for some reason, doing isolation exercises. Then someone taught me how to squat, and the world opened up to me. I loved how it made me like, stronger, and able to run faster and better at picking up heavy crap. Like a week ago, I one arm overhead pressed a Christmas tree. Being stronger than everyone else is sweet.

Part of it's weird, though. I like being strong, but I don't like being "big" or muscular really. I had friends at my height who were 130lbs at my height, and I always wished I could be their size. Now I know that'd be like a concentration camp weight for me, and very unhealthy, but I wish I could be like, really skinny and agile like that. But I just don't have the genetics for it. So to achieve my athletic goals, I have to be stronger, looking at it from a power to weight perspective. The weight will never decrease much (I'll probably always be over 25BMI even at single digit bodyfat) so logically that's the direction I have to go. Just, I always wished I could be like, small. So bodybuilding, as a concept, like "getting bigger" is a weird concept for me to understand being sorta already big.

I'd recommend for lifting, starting with the big power movements. Those'll put on mass quickest. Don't dick around with isolation exercises, just basically do some pressing, squats, and deadlifts, maybe Olympic lifts, but those are pretty technique intensive, and you won't be able to lift much without good technique, I guess injuries are a possibility, too, but I personally haven't really gotten any from Olympic lifts. Pullups and chins are great if you can do them, usually skinny people can do them well. Later on, you can do the isolation exercises once you figure out what muscles you want a little bigger for aesthetic reasons, or are weaknesses in whatever activities you do with them.

Oh well, good luck.

Thanks for the advice! I went for the first time last night and lifted a few weights. What do you mean by resitance though?

Resistance bands are an alternative to iron weights.
look it up.

what I really meant is anything against you, you can't just move around and expect to get strong.

you have to push or pull something difficult if you want to make it easier, hence becoming stronger.

I went to the jym first time in ages on Tuesday night, and my arms have not stopped aching ever since.

I spoke to my personal tutour at college (who is a PE teacher) and he said that I probably lifted too much and advised that I don't go back to the jym for a few days untill I stop aching and then when I go back, start again but on a lower standard.

But I kind of had this plan to go three times a week, so I wanted to go tomorrow. I could just go and not exercise my arms at all, but my abs and legs instead?

He also talked about eating protein and that I should do that to prepare my muscles for my next visit, so for lunch I had a chicken tikka sandwich, a banna custard yogurt thing and a bottle of water. Does that sound like a decent protein meal to you?

Also, how do I know how much is enough protein and callories?

From the cultural difference to chronic lymphocytic leukemia

This press release is available in German.

The Deutsche Forschungsgemeinschaft (DFG, German Research Foundation) will fund three new Research Units and one new Clinical Research Unit. This was decided by the DFG Senate during its 2012 December meeting in Bonn. The purpose of the collaborations is to offer researchers the possibility to pursue current and pressing issues in their subject areas and to establish innovative work directions.

Like all DFG Research Units, the new units will be interdisciplinary and span multiple locations. They will pursue methodologically innovative approaches and ask fundamental questions in their respective disciplines.

The three new Research Units will receive approximately 5.3 million euros over the next three years; the DFG will thus fund a total of 189 Research Units. In the initial three-year funding period, the new Clinical Research Unit will receive approximately 2.1 million euros. The DFG is thus currently supporting a total of 31 Clinical Research Units.

The new units in detail (alphabetically sorted by host university):

The software of smartphones, navigation aids or driving assistance systems in cars is constantly evolving due to regular updates and is thus adapting to new situations and applications. The Research Unit "Controlling Concurrent Change (CCC)" will examine the challenges the independent software updates will face due to an increasingly openly interconnected future, and how these challenges can be met. The individual applications compete with each other for sufficient resources, as the integration of a variety of subsystems and applications on a computer platform creates ever more complex structures and relationships. This creates another problem, that is, how to avoid the adverse effects of specific updates or new installations on the whole computer system or other software programmes. The Research Unit will therefore look for ways of how to control the variety of updates of different software applications without side effects, and how to make computer platforms more robust to ensure proper functioning of different software subsystems.

(Spokesperson: Prof. Dr.-Ing. Rolf Ernst, Technical University of Braunschweig)

Chronic lymphocytic leukemia (CLL) is the most common type of leukemia in the Western world and characterised by an extremely heterogeneous course of disease. The trigger of CLL, which occurs at a higher age, is assumed to be the result of genetic changes that affect or switch off DNA repair mechanisms and thus also important tumour suppressor genes. The aim of the Clinical Research Unit "Exploiting Defects in the DNA Damage Response for the Treatment of Chronic Lymphocytic Leukemia" is to examine what changes occur in the DNA repair network at the molecular level that lead to chronic lymphocytic leukemia. The researchers hope that by identifying the molecular "weak points" they will better understand the reasons for the emergence of this form of leukemia. The aim of the research work is to explore new therapies for the disease, which is immune to conventional chemotherapy.

(Spokesperson: Prof. Dr. Michael Hallek, University of Cologne)

The Research Unit "Un/doing Differences. Practices of Human Differentiation" will examine how cultural differences among people are created, superimposed or overruled. The study will focus on the boundaries that are drawn along languages, religions as well as ethnic or national characteristics and on the distinctions between individuals of a community. Under what conditions are distinctions made? When are differences actualised or neutralised? And what function does a division in human categories fulfil? The researchers hope to find possible answers to these questions by using a comparative research programme that thematically combines the differentiation cases examined individually in cultural sciences so far and couples empirical observation with analytical description.

(Spokesperson: Prof. Dr. Stefan Hirschauer, University of Mainz)

Topics such as rearmament, construction of the welfare state, nuclear power and the peace movement triggered ethical controversies in the "old" Federal Republic between 1949 and 1989 that decisively shaped society. The Research Unit "Protestantism in the Ethical Debates of the Federal Republic of Germany 1949-1989" seeks to determine how and through what institutions Protestantism influenced these ethical discussions or was influenced by them. The aim of the study is to close the research void in the border area of Protestant theology, political science, law and history. The starting point is a programmatically open definition of Protestantism to meet the diverse standpoints of churches and individuals in ethical discussions. With their interdisciplinary approach, researchers intend to reappraise the socio-political contribution of Protestantism in Germany between 1949 and 1989, which has also been influential after German reunification.

(Spokesperson: Prof. Dr. Christian Albrecht, University of Munich)

Deutsche Forschungsgemeinschaft

Census: Whites no longer a majority in US by 2043

WASHINGTON (AP) ? White people will no longer make up a majority of Americans by 2043, according to new census projections. That's part of a historic shift that already is reshaping the nation's schools, workforce and electorate, and is redefining long-held notions of race.

The official projection, released Wednesday by the Census Bureau, now places the tipping point for the white majority a year later than previous estimates, which were made before the impact of the recent economic downturn was fully known.

America continues to grow and become more diverse due to higher birth rates among minorities, particularly for Hispanics who entered the U.S. at the height of the immigration boom in the 1990s and early 2000s. Since the mid-2000 housing bust, however, the arrival of millions of new immigrants from Mexico and other nations has slowed from its once-torrid pace.

The country's changing demographic mosaic has stark political implications, shown clearly in last month's election that gave President Barack Obama a second term ? in no small part due to his support from 78 percent of non-white voters.

There are social and economic ramifications, as well. Longstanding fights over civil rights and racial equality are going in new directions, promising to reshape race relations and common notions of being a "minority." White plaintiffs now before the Supreme Court argue that special protections for racial and ethnic minorities dating back to the 1960s may no longer be needed, from affirmative action in college admissions to the Voting Rights Act, designed for states with a history of disenfranchising blacks.

Residential segregation has eased and intermarriage for first- and second-generation Hispanics and Asians is on the rise, blurring racial and ethnic lines and lifting the numbers of people who identify as multiracial. Unpublished 2010 census data show that millions of people shunned standard race categories such as black or white on government forms, opting to write in their own cultural or individual identities.

By 2060, multiracial people are projected to more than triple, from 7.5 million to 26.7 million ? rising even faster and rendering notions of race labels increasingly irrelevant, experts say, if lingering stigma over being mixed-race can fully fade.

The non-Hispanic white population, now at 197.8 million, is projected to peak at 200 million in 2024, before entering a steady decline in absolute numbers as the massive baby boomer generation enters its golden years. Four years after that, racial and ethnic minorities will become a majority among adults 18-29 and wield an even greater impact on the "youth vote" in presidential elections, census projects.

"The fast-growing demographic today is now the children of immigrants," said Marcelo Suarez-Orozco, a global expert on immigration and dean of UCLA's Graduate School of Education & Information Studies, describing the rate of minority growth in the U.S. as dipping from "overdrive" to "drive." Even with slowing immigration, Suarez-Orozco says, the "die has been cast" for strong minority growth from births.

As recently as 1960, whites made up 85 percent of the U.S., but that share has steadily dropped after a 1965 overhaul of U.S. immigration laws opened doors to waves of new immigrants from Mexico, Latin America and Asia. By 2000, the percentage of U.S. whites had slid to 69 percent; it now stands at nearly 64 percent.

"Moving forward, the U.S. will become the first major post-industrial society in the world where minorities will be the majority," Suarez-Orozco said. With the white baby boomer population now leaving the workforce, the big challenge will be educating the new immigrants, he said.

The U.S. has nearly 315 million people today. According to the projections released Wednesday, the U.S. population is projected to cross the 400 million mark in 2051, 12 years later than previously projected. The population will hit 420.3 million a half century from now in 2060.

By then, whites will drop to 43 percent of the U.S. Blacks will make up 14.7 percent, up slightly from today. Hispanics, currently 17 percent of the population, will more than double in absolute number, making up 31 percent, or nearly 1 in 3 residents, according to the projections. Asians are expected to increase from 5 percent of the population to 8 percent.

Among children, the point when minorities become the majority is expected to arrive much sooner, by 2018 or so. Last year, racial and ethnic minorities became a majority among babies under age 1 for the first time in U.S. history.

At the same time, the U.S. population as a whole is aging, driven by 78 million mostly white baby boomers born between 1946 and 1964. By 2030, roughly 1 in 5 residents will be 65 and older. Over the next half century, the "oldest old" ? those ages 85 and older ? will more than triple to 18.2 million, reaching 4 percent of the U.S. population.

The actual shift in demographics will be shaped by a host of factors that can't always be accurately pinpointed ? the pace of the economic recovery, cultural changes, natural or manmade disasters, as well as an overhaul of immigration law, which is expected to be debated in Congress early next year.

"The next half century marks key points in continuing trends ? the U.S. will become a plurality nation, where the non-Hispanic white population remains the largest single group, but no group is in the majority," said acting Census Bureau Director Thomas Mesenbourg.

Republicans have been seeking to broaden their appeal to minorities, who made up 28 percent of the electorate this year, after faring poorly among non-whites on Election Day, when Republican presidential candidate Mitt Romney carried only about 20 percent of non-white votes.

The race and ethnic changes are already seen in pockets of the U.S. and in the younger age groups, where roughly 45 percent of all students in K-12 are Hispanics, blacks, Asian-Americans and others. Already, the District of Columbia and four states ? Hawaii, California, New Mexico and Texas ? have minority populations greater than 50 percent; across the U.S., more than 11 percent of counties have tipped to "majority-minority" status.

Last month, nearly all voters over age 65 were white (87 percent), but among voters under age 30, just 58 percent were white.

"Irrespective of future immigration and minority fertility patterns, the U.S. is facing a stagnating white population," said William H. Frey, a demographer at the Brookings Institution. "The biggest shift will occur over the next 20 years as the mostly white baby boom generation moves into traditional retirement years. It is in the child and early labor force ages where we must be ready for the greatest changes as new American minorities take over for aging whites."

Economically, the rapidly growing non-white population gives the U.S. an advantage over other developed nations, including Russia, Japan and France, which are seeing reduced growth or population losses due to declining birth rates and limited immigration. The combined population of more-developed countries other than the U.S. has been projected to decline beginning in 2016, raising the prospect of prolonged budget crises as the number of working-age citizens diminish, pension costs rise and tax revenues fall.

Depending on future rates of immigration, the U.S. population is estimated to continue growing through at least 2060. In a hypothetical situation in which all immigration ? both legal and illegal ? immediately stopped, previous government estimates have suggested the U.S. could lose population beginning in 2048.

"Young families ? many of them first or second-generation immigrants ? have been the engine of U.S. population growth for several decades," said Mark Mather, associate vice president of the Population Reference Bureau.

Investing in China ? Pitfalls and Promise | The Big Picture

Great People ? Terrible Economic Model

As I have repeated in a number of past issues, China is following its own version what author Eamonn Fingelton has called the East Asian Economic Model. According to Fingelton, this model was first followed by Japan in its WW II puppet state in Manchuria, then in post-War Japan itself, then Taiwan and Korea and now China. The Chinese version of the model relies on protectionism, heavy promotion of exports by subsidies and an undervalued exchange rate and a State/Communist Party directed over- allocation of resources to investment including real estate and infrastructure projects. The model has been enormously successful in its early stages in raising living standards but as the movement from the countryside subsides and exports in the current global near recession can?t be dramatically increased, the Chinese model has reached a dead end of diminishing marginal returns on capital.

This is where China is heading. All those airports, railroads, empty cities etc etc are going to turn in an ever lower return on capital. Chinese proudly point to their spanking new infrastructure. Americans in the post Civil War era could have proudly pointed to their new, partly subsidized coast to coast railroad system as well. But British investors in American railroad securities often lost their shirts.

So it is today with investors in Chinese stocks. Yes the Chinese people are hardworking, literate, relatively obedient and totally obsessed with getting rich. Good qualities for investors and ones that go a long way to offset what is really a terrible economic system. But investors have to be careful.

Observers have noted with some wonderment that the Shanghai A Share Index has gone down for three straight years. No surprise as far as I?m concerned. The companies in the A Share Index are largely majority state owned enterprises (SOEs). These companies on balance destroy capital. Their investment decisions are often made with State/Party directives in mind and they are recipients of subsidized below market bank loans. And the SOE?s have preferential treatment as far as access to the Shanghai stock exchange goes.

The contrast couldn?t be greater with true private sector Chinese companies which in many ways are starved for capital. I have looked at a number of private Chinese companies and with company after company I can find no or low debt. Growth is funded out of internal cash flows. Most of the true private sector companies have had to raise equity capital abroad in New York or Hong Kong.

Forcing their own companies to raise capital in the US doesn?t make a whole lot of sense for China, which has such a high savings rate and a huge cache of foreign reserves. What seems to have happened is that the bulk of China?s savings are misdirected into the state sectors while the true private sector companies have to scrounge for capital abroad. This has led to a number of problems and value discrepancies.

It is curious that the Hong Kong stock exchange wasn?t more aggressive in getting these Chinese companies to list in Hong Kong. As discussed in a previous essay, after an initial infatuation phase the Chinese companies listed in the US have become ?orphans?, misunderstood, suspected of being frauds and grossly undervalued in many cases. Of course it hasn?t helped that some of them were indeed frauds.

One Way to Buy China?Invest in Southeast Asia

Investing in companies is ultimately about investing in people. One ideal combination (not the only one to be sure) is the Chinese work ethic (the Puritan ethic as it used to be called in the US) without the Chinese economic and legal system. And in a number of Southeast Asian countries, especially Singapore, Malaysia, Thailand and the Philippines, that is what you get. You get a business community which is signifcantly Chinese in origin. Chinese entrepreneurs are legends in this part of the world. But you also get market friendly legal/economic systems that are either British (Singapore, Malaysia) or American (the Philippines) in origin or at least heavily influenced by Western legal traditions (Thailand).

It goes beyond that. Southeast Asia is the destination of an ever increasing number of Chinese tourists as well as foreign investments. China is the number one destination for ASEAN (Association of South East Asian Nations) exports. So to a large extent Southeast Asia is part of the China growth story but without some of the drawbacks. Of course, if China were to have a really hard landing that would be a negative for Southeast Asia as it would be for the rest of the world.

But Southeast Asia is more than a China story. Consider:

  1. Southeast Asia is also the destination of an increasing number of Indian tourists and foreign investment.
  2. The banking systems and external debt situations?partly as a result of the Asian crisis of 1998?are in sound shape as opposed to those in the West, the more opaque and unbalanced Chinese system and the corrupt and bureaucracy laden Indian economy.
  3. The market driven nature of Southeast Asian economies means the overinvestment imbalances of the Chinese economy are absent in Southeast Asia. State intervention in Southeast Asian economies compared with China or the West is relatively minimal.
  4. The major Southeast Asian economies are growing at healthy but not unsustainable five percentish rates.
  5. As an added bonus the English language is the working language of ASEAN and is also widely used in Singapore, the Philippines, Malaysia, Brunei, Myanmar and even Thailand.
  6. The majority of ASEAN countries are democracies. ASEAN has the longer term potential to become a meaningful economic entity. (Hopefully not exactly like the European Economic Union.)

The major exception to this otherwise favorable picture is Vietnam. Vietnam has a Chinese style State/Communist Party controlled political and economic system. It?s no wonder Vietnam has been such a big disappointment in recent years. Vietnam spent a thousand years or so fighting off Chinese attempts to make the country into another Chinese province. But as any visitor will attest Vietnam seems in so many ways ? culturally, politically ? like China.

The one disadvantage for foreign investors in Southeast Asia is that most of the companies are small and do not have ADRs in New York. But herein lies the opportunity for those willing to take the time. These markets are underfollowed and growth opportunities do exist. These companies have websites usually in English. Information thanks to the internet is not the problem it used to be.

Regulators from Hell (1)?Will All Chinese Stocks in the US Be Delisted?

The SEC said Dec. 3 that Deloitte Touche Tohmatsu CPA Ltd., Ernst & Young Hua Ming LLP, KPMG Huazhen and PricewaterhouseCoopers Zhong Tian CPAs Ltd. have refused to cooperate with accounting investigations into nine companies traded in the U.S. The SEC hasn?t named the nine stocks it?s focused on. The issue is the US accounting affiliates will not provide documents required by the SEC for its investigation of fraud because they claim this would be in violation of Chinese law. The SEC is threatening the US firms with penalties if the documents are not provided.

If the SEC order is carried out to its logical conclusion all Chinese stocks will eventually have to be delisted from US stock exchanges since no accounting firm acceptable to the SEC will put itself in the position of having to not comply with an SEC order . This would mean the delisting of hundreds of companies including some major ones like Baidu or Sina. It also may bring problems for American multinationals that operate in China and require local auditors for these operations. This SEC order would bring about a major destruction of value for US investors as the rug of liquidity would be pulled out from under these Chinese stocks. Leveraged buyouts would be transacted at a fraction of these firms? true value. I cannot judge who is being unreasonable in this case?the Chinese or the Americans ? and there certainly is a need for vigilance against fraud with Chinese stocks. But from the viewpoint of the American investor in Chinese stocks this SEC action has a ?burn the village in order to save it? feel. One would hope adult behavior could prevail and this issue gets sorted out. One would have thought this issue could have been sorted out before the Chinese firms listed in the US.

The delisting of all Chinese companies would be another nail in the coffin of New York?s hopes to become the global center for equity financing. As if Sarbanes Oxley wasn?t enough. If the Hong Kong exchange were smart, it would open a special pathway for these companies to migrate from New York to Hong Kong.

Regulators from Hell (2) ? Go for the Money

?The American extortion of Standard Chartered is nearly over. The British bank is ready to pay off, sorry I mean settle with, the rest of the US mafia crew otherwise known as federal regulators, with a fine of US$330 million for breaching US sanctions against Iran? The US is tough on foreigners, but it is anything but with its own companies. In the past decade, the US Treasury Department granted exemptions to almost 4,000 US companies to do business worth billions of dollars with countries under sanctions, such as Iran, Sudan and Cuba.?

-Alex Ho, MY TAKE, South China Morning Post, Dec 7, 2012

The above is one unhappy Hong Kong journalist?s opinion. But it is pretty much my opinion as well. HSBC and Standard Chartered have been made to pay enormous fines for ostensibly violating American foreign policy. HSBC and Standard Chartered have a long and honorable history going way back in Hong Kong. They are still respected institutions there and comprise, along with Bank of China, the note issuing banks in the territory. The American regulators on the other hand represent bankrupt Federal and State governments. Because of the size of the US economy and the role the dollar plays in the world economy, dollar transactions must be cleared through the US. Like the medieval barons of old who exacted extortionate tolls on commerce transiting through their territory, the US regulators are doing likewise.
